Terms of Use for the PriceCheck AI Plugin

The short version

  • The Plugin is free and read-only. It looks up products, prices, price history, reviews and trends from PriceCheck for your AI assistant.
  • Always check with the retailer before you buy. Prices and stock change often, and we can't guarantee that every listing is accurate or current.
  • We don't sell anything through the Plugin. Any purchase is between you and the retailer.
  • Your AI assistant writes the answers. It may summarise or interpret our data incorrectly, so check the PriceCheck product page if something looks wrong.
  • Use it fairly. No scraping, bulk downloading, reselling our data or overloading the service.

These short points don't replace the full terms below.

1. About these terms

These Terms of Use (the "Terms") govern your use of the PriceCheck AI Plugin (the "Plugin"). The Plugin is provided by PriceCheck (Pty) Ltd ("PriceCheck", "we", "us" or "our").

By installing, connecting or using the Plugin, you agree to these Terms. If you don't agree, please don't use the Plugin.

These Terms apply only to the Plugin. The PriceCheck website has its own terms.

Please read the clauses marked in bold. They limit our responsibility, place risk on you, or require you to indemnify us. The Consumer Protection Act 68 of 2008 (the "CPA") asks that such clauses be brought to your attention.

2. The service

The Plugin lets an AI assistant you use, such as Claude or ChatGPT, look up PriceCheck data on your behalf. This includes:

The Plugin is read-only. It can't place orders, make payments, create accounts or change anything on PriceCheck or a retailer's site. The Plugin is currently free. We will give notice on this page before charging for any part of it.

3. Who may use the Plugin

You may use the Plugin if you can lawfully use the AI platform you connect it to and you follow that platform's own terms. If you use the Plugin for an organisation, you confirm that you may accept these Terms for it.

4. Acceptable use

The Plugin is for personal shopping research and normal business research. You must not, and must not help anyone else to:

  1. scrape, crawl, harvest or bulk-download data through the Plugin, including by sending automated or scripted requests at volume;
  2. use PriceCheck data to build, train, feed or improve a competing price comparison service, product database or dataset;
  3. resell, sublicense, republish or commercially redistribute data obtained through the Plugin, except brief quotes with a link to the PriceCheck page;
  4. overload, disrupt or interfere with the service, or get around rate limits, access controls or security measures;
  5. probe, scan or test the service for vulnerabilities without our written permission;
  6. reverse engineer the service, except where the law allows this despite this restriction;
  7. use the Plugin for anything unlawful, fraudulent or misleading, including passing off PriceCheck data as your own or misrepresenting a relationship with PriceCheck;
  8. deliberately send personal information about other people in search requests.

We may apply rate limits and other technical limits to keep the service fair and available for everyone.

5. Prices, listings and reviews

PriceCheck gathers product, price and stock information from retailers and other sources. We do our best to keep it accurate, but we don't guarantee that any price, listing, specification, availability or delivery detail is correct, complete or current. Retailers can change prices and stock at any time, and some changes may not reach PriceCheck straight away.

Always confirm the price, stock, delivery, warranty and returns terms on the retailer's own site before you buy.

6. AI assistant answers

Your AI assistant, not PriceCheck, decides which PriceCheck tools to call. It also writes the answer you see. It may misread your request, choose the wrong product, summarise our data incorrectly, or add information that didn't come from PriceCheck. We aren't responsible for the content of AI-generated answers. The PriceCheck product page linked in a result is the authoritative source for PriceCheck's data.

7. Purchases from retailers

PriceCheck is a price comparison service, not a seller. If you buy something after using the Plugin, you buy it from the retailer. The contract is between you and that retailer, on the retailer's terms. Questions about orders, payment, delivery, returns, refunds and warranties go to the retailer. Your rights as a consumer against the retailer under the CPA are not affected.

8. AI platforms and third-party sites

You use the Plugin through an AI platform run by another company, such as Anthropic or OpenAI. That platform's terms and privacy policy apply to your use of it. We don't control the platform, its availability or how it handles your conversations.

Results link to PriceCheck pages and, through them, to retailer websites. We don't control retailer websites and aren't responsible for their content, products, practices or availability.

9. Intellectual property

The Plugin and PriceCheck's data, content, compilation of listings, software, name, logo and trade marks belong to PriceCheck or its licensors. They are protected by intellectual property laws. Retailer names, product names and brands belong to their owners.

While you follow these Terms, we give you a personal, revocable, non-exclusive, non-transferable licence. It lets you use the Plugin and the results it returns for your own shopping research and normal business research. You may share individual results, such as a product price with its PriceCheck link. Sections 4(2) and 4(3) limit what else you may do with our data.

10. Privacy

Our Plugin Privacy Policy explains what information the Plugin collects and how we use it. In short, we don't track you, but we do keep records of searches, the products returned and related preferences.

11. Availability and changes

We aim to keep the Plugin available and working, but we don't promise that it will always be available, uninterrupted or error-free. We may change, add or remove tools and features, limit use, or stop offering the Plugin. We will try to give notice of significant changes on this page where reasonably possible.

12. Disclaimers

To the extent the law allows, the Plugin and all information it returns are provided "as is" and "as available". We give no warranties, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose or uninterrupted availability.

Nothing in these Terms excludes or limits any right or warranty that the law, including the CPA, says cannot be excluded or limited.

13. Limitation of liability

To the extent the law allows:

These limits don't apply to loss caused by our gross negligence, wilful misconduct or fraud. They also don't apply to any liability the law, including the CPA, says cannot be limited.

14. Indemnity

To the extent the law allows, you indemnify PriceCheck, its directors, employees and agents against claims, losses and reasonable legal costs that arise because you broke these Terms, in particular section 4 (Acceptable use), or broke the law while using the Plugin.

15. Suspension and termination

You can stop using the Plugin at any time by disconnecting or uninstalling it in your AI assistant.

We may suspend or block access to the Plugin, including access from particular platforms, networks or patterns of requests, if we reasonably believe that:

Sections 5, 6, 7 and 9 to 17 continue to apply after your use ends.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. If a dispute arises, please contact us first so we can try to resolve it. If it isn't resolved, it may be referred to the courts of South Africa. We may also pursue claims in any court with jurisdiction. As a consumer, you keep any right you have under the CPA to refer a complaint to the National Consumer Commission, an ombud, the National Consumer Tribunal or a consumer court.

18. Changes to these terms

We may update these Terms when the Plugin, our practices or the law changes. We'll post the new version on this page and update the "Last updated" date. For significant changes, we'll give notice on this page before they take effect where reasonably possible. If you keep using the Plugin after changes take effect, you accept the updated Terms.
